THE CHILD CRIME PREVENTION THROUGH A RESTORATIVE JUSTICE OF THE INDIGENOUS PEOPLE LOCAL WISDOM
Abstract
Child crime has a negative impact on the society as well as the children themselves. Children
are an integral part of human survival, the survival of a nation and a state, have a strategic
role expressly stated in the constitution that the state guarantees the right of every child for
survival, growth and development as well as the protection from various forms of violence
and discrimination. The violations of behavior or unlawful acts by children cannot be entirely
blamed on themselves, it is because there are various factors outside them to commit a crime.
Therefore it is necessary for comprehensive crime prevention efforts both penal and nonpenal. In order to avoid the children away from judicial proceeding and stigmatization, the
settlement of child cases can be withdrawn from the judicial proceeding out of the criminal
justice proceeding through a restorative justice. The participation of all parties is urgently
needed to jointly address the problem by involving the victims, children and indigenous
people in finding solutions to restore the situation as before without retaliation.
