Abstract

There are cases involving Retired Members Indonesian National Army
prosecuted in the Military Court. Retired Members Indonesian National Army are considered
civilians, which should be prosecuted in the General Court. This irregularity triggers debates
on how the Military Court’s authority is exercised in prosecuting Retired Indonesian National
Soldiers.
