THE INFLUENCE OF CONSTITUTIONAL TEXTS ON THE CONVICTION OF THE CRIMINAL JUDGE

Abstract

Criminal law is based on a number of important principles. These principles together
constitute a safety valve for all individuals addressed to the provisions of the rules of this
important law. This law is entrusted with the task of ensuring the protection of the rights of
individuals. It also provides stability to their legal positions. Legislators gave this law a great
deal of interest in the various constitutional systems as constitutions are the center of balance
between both power and freedom. Therefore, they include a number of important principles
and other rules that together constitute important guarantees for individuals against
criminalization and punishment. They represent the aspect of constitutional legitimacy of the
rules of criminal law which in turn, has the greatest effect on influencing the criminal judge
because of the superiority of those rules over other legal rules in the state.
